The Biden administration is expected to withdraw the nomination of Michael Delaney to serve on the First Circuit Court of Appeals, according to a person familiar with the matter.
Several Democrats on the Judiciary Committee were resisting supporting Delaney, in part because of his past work defending a school in a civil lawsuit over sexual assault. Delaney was not called up for a vote on Thursday in the panel.
